The following cases were recently reported by the Hon Mr Justice Bokhary. See below for His Lordship’s remarks and observations by way of Editor’s Notes.

Shoikhet v Chen Guoqiang [2022] 3 HKLRD 238

“As email fraud is all too common these days, this judgment is instructive to those dealing with such cases.”

Secretary for Justice v Sudewo [2022] 3 HKLRD 246

“This case shows the Court giving for contempt of court the same discount as would be given in a criminal case.”

Lam King Nam v Secretary for Justice [2022] 3 HKLRD 421

“While stressing that ignorance of the law is no defence, and the importance of compliance with election rules, the Court noted: the absence of bad faith; the genuine efforts made to understand the rules; that this was a case of inadvertence; that prompt remedial action was taken; and that it would not be unjust to grant the relief sought.”

Ip David (Dr) v Medical Council of Hong Kong [2022] 3 HKLRD 429

“This judgment illustrates the application of Ladd v Marshall in a disciplinary hearing and somewhat unusual context.”

HKSAR v Mohammad Fakhrul Alfaqih Bin Saadon [2022] 3 HKLRD 483

“The Court of Appeal, having referred to the vexed and recurring question of the utility of information provided by a defendant or appellant late in the proceedings, has provided the foregoing guidance on that question.”
